These Terms of Service ("Terms") govern your access to and use of our website located at liftcitycustoms.com (the "Site"), our vehicle customization services (including wheels, tires, lift kits, window tint, and other modifications), our SMS text messaging program, and any related services (collectively, the "Services").

By accessing the Site or utilizing our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site or Services.

1. Services Provided

Lift City Customs LLC provides automotive customization services. All descriptions of products, services, and pricing on our Site are subject to change at any time without notice. We reserve the right to modify or discontinue any Service at any time. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

2. Financing

We offer financing options through third-party lending partners, including but not limited to Kafene, Acima, U-Own, Progressive, A+, American First, Snap, KornerStone, and LendMark.

•Approval: All financing approvals are determined solely by the third-party lenders, not by Lift City Customs LLC.

•Data Collection: By applying for financing through our Services, you consent to the collection and transmission of your sensitive personal information (including your Social Security Number) to these third parties for the purpose of credit approval.

•Third-Party Terms: Your relationship with any financing partner is governed by their respective terms and conditions and privacy policies. Lift City Customs LLC is not responsible for the terms, rates, decisions, or actions of any third-party lender.

3. SMS and Text Messaging (A2P 10DLC Compliance)

By providing your mobile phone number, you agree to receive SMS text messages from Lift City Customs LLC for purposes including appointment reminders, order updates, and promotional offers.

•Phone Numbers: Messages will be sent from (346) 496-4534 (New Caney location) or (936) 249-1602 (Magnolia location).

•Opt-In: You agree that by opting in, you authorize us to send text messages to the mobile number provided.

•Opt-Out: You may cancel the SMS service at any time. Just text "STOP" to the shortcode or number you received the message from. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

•Help: If you are experiencing issues with the messaging program, you can reply with the keyword "HELP" for more assistance, or you can get help directly at info@liftcitycustoms.com.

•Rates and Frequency: Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

•Privacy: For privacy-related inquiries regarding SMS, please refer to our Privacy Policy. Text messaging originator opt-in data and consent will not be shared with any third parties for their marketing purposes.

4. User Conduct

You agree to use the Site and Services only for lawful purposes. You agree not to:

•Use the Site in any way that violates any applicable federal, state, local, or international law or regulation.

•Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site.

Note regarding vehicle modifications: Certain modifications (such as lift kits or window tints) may affect your vehicle's factory warranty or compliance with local laws. It is your responsibility to ensure that any modifications comply with applicable laws and do not void your warranties.

In no event will Lift City Customs LLC, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Site, any websites linked to it, any content on the Site or such other websites, or any services or items obtained through the Site or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
